Service Agreements

This is an all-in-one membership which includes the Smart Credit Report® & Scores, ScoreTracker, ScoreBuilder®, ScoreMaster®, PrivacyMaster®, Credit Monitoring, Alerts, $1MM Identity Fraud Insurance (activation required) and Money Manager all tied together with action buttons direct-to-your-creditors for any questions or needs.

Our product has a monthly Membership fee and we have various plans to choose from. See Membership Options & Pricing to determine which Membership plan best suits your needs. You will be billed once per month on the anniversary of your bill date and your services will be renewed each month unless you cancel your membership. If your bill day is not available on a particular month, then you will be billed on the last day of that month.

You may cancel your Membership at any time by (1) using our Notice of Cancellation form below, or (2) log in to your account, or (3) call our customer service at (866) 991-1113.

THIS AGREEMENT HAS AN ARBITRATION CLAUSE AND A CLASS ACTION WAIVER.

WE DO NOT PROVIDE CREDIT REPAIR SERVICES OR CREDIT REPAIR ADVICE.  WE DO NOT CLAIM THAT WE ARE ABLE TO “CLEAN UP” OR “IMPROVE” YOUR CREDIT RECORD, CREDIT HISTORY OR CREDIT RATING.  ANY MENTION OF THE WORD “IMPROVE” OR “GOAL” IS COINCIDENCE AND DOES NOT CARRY THE SAME MEANING AS CLEANING UP OR IMPROVING ONES CREDIT RATING.

The Smart Credit Report® is not a credit report as traditionally known or viewed. The Smart Credit Report® is entirely different. It contains additional data and formatting that is not similar to a traditional credit report. Account Registration

By providing the information requested during our enrollment process, you will be given full access to the site for any paid membership. You must read the Important Consumer Notices and agree to the Membership Service Agreement which are shown below. You will also be accepting our Privacy Policy and Terms of Use where you are giving your permission to match you with offers, products and Apps that may be suited for you. We will not share your information with any third party without your express permission. See our Privacy Policy for more information.

Your Membership includes the following products:
Smart Credit Report®

This is a revolutionary new type of Credit Report and is not to be confused with a traditional credit report. What makes it so different is the way information is shown to you and how you can interact with your creditors by using action buttons. It also has a zoom feature to see more credit details and even your daily transactions that ultimately compromise of the information reported by a credit reporting agency.

Scores and ScoreTracker

Each of your Scores has a number ranging from bad to excellent along with a letter grade and how you compare to others. You also get a detailed overview of your Scores. All Scores are estimates and are for educational purposes only. They cannot be used to determine final credit.

Credit Score:

This is your credit score and its number range is 300-bad to 850-excellent. This score is a general representation of your credit risk lenders use to grant credit.

Auto Score:

This represents your possible risk to lenders if you purchase or lease a vehicle.

Insurance Score:

This represents your possible risk to an insurance company if they are underwriting your insurance.

Hiring Risk Index:

Many employers are allowed to view your credit report (not your credit score), when determining hiring or promotion. This Hiring Risk Index can help you better understand how employers may interrupt your credit report.

ScoreBuilder®

ScoreBuilder® is a 120 day program to better understand what is helping or hurting your credit score and view possible actions you can take on your own.

ScoreMaster® is also a great educational tool to better understand how your credit score works.

ScoreMaster® is a simulator showing possible outcome(s) of your credit score based upon certain actions you may optionally take that affects the statement balance reported by your creditor or bank. Alerts

This monitors information that is posted to a credit reporting agency (specifically TransUnion) or financial accounts once you add them to Money Manager. Some monitoring Alerts you may get are more important and urgent than others. For these important Alerts we recommend you activate Alerts on your phone. This will put an action button in your Alert to help you remove identity theft right from your phone without the need to log in to your account.

In addition, you will get various Alerts keeping you informed of the latest concerning your Money, Credit and Identity. The Alerts are simple and well organized for you. They include Alerts about your Membership, credit monitoring, identity theft alerts, creditor responses to your Actions and when payments are due on your Money Manager linked accounts.

Make sure you allow our Alerts to get to your email in-box by instructing your email that our Alerts are NOT spam.

$1MM Identity Fraud Insurance (if applicable)

Your $1mm Identity Fraud Insurance (“Fraud Insurance”) is underwritten and administered by Voyager Indemnity Company, an Assurant Specialty Property Company (“Assurant”) under a master group policy issued to ConsumerDirect, Inc®. for the benefit of it and its partners members.

BASED ON YOUR MEMBERSHIP, FRAUD INSURANCE MAY NOT BE AUTOMATICALLY ACTIVATED WHEN YOU ENROLL AS A MEMBER. YOU MUST ACTIVATE YOUR FRAUD INSURANCE.

The complete policy is available in the Fraud Insurance section of your membership. Please note that New York and Texas may have certain restrictions or prohibitions.

Assurant administers all claims and ConsumerDirect, Inc®. shall have NO responsibility with respect to ANY Fraud Insurance benefit.

PrivacyMaster® (if applicable)

We scan and monitor for websites & data brokers who might be selling or misusing your personal information and alert you when discovered.

You can then instruct them to Opt-Out of their sharing or selling your personal information. Or you can instruct them to completely Remove your personal information providing you do not have an open account with them.

We will monitor their compliance with your Opt-Out or Remove instructions.

You will get periodic alerts with updates and results. Your results may take from 1 to 45 days depending upon the responsiveness of the website or data broker’s compliance with your instructions. Results are not guaranteed and may vary.

Money Manager

Link your online bank accounts, credit cards, loans, utilities and investment accounts to Money Manager. This lets you see individual transactions, monthly statements and get payment due notices updated every day.

The details of these linked accounts are shown in Money Manager located on your Member home page and also attached to your creditor data on the Smart Credit Report®. If you view a creditor in your Smart Credit Report®, the transactions will appear as well.

Having all your money, credit and identity in one place is very simple and convenient, especially when you use an action button to ask your credit something.

Action Buttons*

Use the action buttons, located throughout the site, to communicate directly with your creditors for any questions, problems or requests you may have. It is very fast, you don’t need account numbers, or have to worry about business hours. Best of all, you don’t have to talk to anyone. Just push the button.

When a creditor replies to your Action request they may reply through our system which will then generate an Alert to you. Or, the creditor may reply directly to your home address. A creditor’s reply may vary depending on the general responsiveness of the creditor and your Action request. Please allow reasonable time for your creditor(s) to respond to your Action(s).

A creditor may reply with acceptance, denial, counter-offer or request for more information. In some cases, a creditor may not respond at all. In other cases, multiple Actions may be required to get the result you desire. Results or replies to your Action(s) are not guaranteed. Delivery of your Action(s) to a creditor is not guaranteed. We do reserve the right to reject any of your Actions for unnecessary repetition, frivolous requests or foul language.

You have until midnight, Pacific Time, to cancel your Action. After which our system will automatically fulfill your Action request.

Unlimited Scores is defined as 3 full Smart Credit Report® and Score updates per billing period. For the integrity of our product and for your protection, any request to exceed this will have to be determined as non-frivolous. ** Unlimited Actions are defined as 10 Actions per billing period. For the integrity of our product and for your protection, any Actions exceeding this will have to be determined as non-frivolous. ***Additional 3-Bureau Credit Report & Scores may be ordered with all active for a one-time fee if applicable. You may order up to one 3-Bureau Credit Report & Scores per day. The 3-Bureau Credit Report & Scores is available for 12 months or until a new 3-Bureau Credit Report & Scores has been ordered, at which point, the new report and scores will replace any existing 3-Bureau Credit Report & Scores.

We reserve the right to offer you different Membership plans at any time where the monthly charge, Actions per billing period and updates to your Credit Scores per billing period maybe different than listed above.

Our prices are subject to change at any time. Prior to any price increase, we will give you notice, and you may cancel your Membership if you do not agree to the increase.

When you enroll in Membership our system may validate your method of payment to verify your identity and check for fraud. If you have not cancelled your Membership, we reserve the right to use an industry standard credit/debit card updater to update your method of payment should your current method of payment be lost, stolen or expired.

We reserve the right to cancel your Membership without notice, if in our sole and exclusive determination, we find abuse of our system, including, but not limited to: improper enrollment information, false or failed credit cards and frivolous use of our action buttons or our Smart Credit Report®.

How does the Cancellation Policy work?

Canceling your Membership Account will immediately cease any additional charges. You agree to pay any accumulated, unbilled charges through the date of your cancellation, at the time of your cancellation. You may reactivate your account at any time.

Upon cancellation, you will lose access to the areas of the service designated for Members only and lose access to your data and other benefits. This could include any credit data and analysis that may have been displayed during your Membership.

IMPORTANT CONSUMER NOTICES

Please read the following important consumer notices carefully.

WE ARE REQUIRED BY CERTAIN LAWS TO DISCLOSE THE FOLLOWING: “ONLY THE CREDIT BUREAUS CAN REMOVE OR CORRECT INACCURATE, UNVERIFIABLE, OR OUTDATED INFORMATION, FROM YOUR CREDIT REPORT(S), WHICH HAS NOT BEEN CLAIMED TO BE ACCURATE BY THE CREDITOR WHO SUBMITTED THE INFORMATION TO THE CREDIT BUREAUS. YOU MAY SEEK TO HAVE ANY INACCURATE INFORMATION CORRECTED AND, IF APPROPRIATE, REMOVED BY THE CREDIT BUREAUS TO THE EXTENT REQUIRED UNDER APPLICABLE FEDERAL AND STATE LAWS, INCLUDING THE FAIR CREDIT REPORTING ACT. CONSUMER CREDIT FILE RIGHTS UNDER STATE AND FEDERAL LAW

You have a right to obtain a copy of your credit file from a consumer credit reporting agency. They may charge a reasonable fee not to exceed eleven dollars ($11). There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information on your credit report within the preceding 60 days. There is also no fee if you certify that you are unemployed and intend to apply for employment during the next sixty (60) days, that you are a recipient of public welfare assistance, or that you have reason to believe that your file at such credit reporting agency contains inaccurate information due to fraud. You also have the right to receive one free copy of your credit report from each consumer credit reporting agency per year at the www.annualcreditreport.com web site.

The credit data provided or requested through our product is not intended to constitute the disclosure of information by a credit reporting agency as required by the Fair Credit Reporting Act or similar laws.

In addition, if you reside in the state of Colorado, Maine, Maryland, Massachusetts, New Jersey, or Vermont, you are entitled to receive a free copy of your credit report once a year and if you reside in the state of Georgia, you are entitled to receive a free copy of your credit report twice a year. Otherwise, a consumer reporting agency may impose a reasonable charge for providing you with a copy of your credit report.

You have a right to dispute inaccurate information by contacting the consumer credit reporting agency directly. However, neither you nor any company or credit services organization has the right to have accurate, current, and verifiable information removed from your credit report. Under the Federal Fair Credit Reporting Act, the consumer credit reporting agency and/or the reporting creditor must remove accurate negative information from your report only if it is over seven years old. Bankruptcy information can be reported for 10 years.

YOU UNDERSTAND ANY ACTIONS YOU MAY TAKE DO NOT GO TO ANY CREDIT REPORTING AGENCY/CREDIT BUREAU, BUT ONLY TO YOUR CREDITOR AS YOU SELECT AND INSTRUCT. IT IS YOUR CREDITOR’S SOLE AND ABSOLUTE DISCRETION TO RESPOND TO YOUR ACTION AS THEY DEEM NECESSARY. YOU ARE NOT REQUIRED TO PURCHASE YOUR CREDIT REPORT FROM US TO COMMUNICATE WITH YOUR CREDITORS. YOU MAY COMMUNICATE DIRECTLY WITH YOUR CREDITORS FOR ANYTHING YOU WISH AT ANY TIME.

If, separately from using our product, you have notified a credit reporting agency in writing that you dispute the accuracy of information in your credit file, the consumer reporting agency must then reinvestigate and modify or remove inaccurate information. The consumer credit reporting agency may not charge a fee for this product. Any pertinent information and copies of all documents you have concerning an error should be given to the consumer credit reporting agency. If reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the consumer credit reporting agency, to keep in your file, explaining why you think the record is inaccurate. The consumer credit reporting agency must include your statement about disputed information in any report it issues about you.

Nonprofit credit counseling services are available, usually without fees, to counsel you as to credit management and/or consolidation. Additionally, many of our product features you may perform on your own, such as our Actions. We are simply a neutral technology allowing consumers to communicate with their Creditors for whatever they need.

In compliance with our license (AND AS A SAFE HARBOR) with the State of California, we hold a Surety Bond #57BSBFN9192 as a credit services organization. To submit a claim against The Hartford Bond, its address is: One Hartford Plaza, Hartford, CT 06155

The E-Sign Act grants that electronic signatures on documents hold equivalent legal status as traditional handwritten signatures. By completing our online Membership Agreement, you certify that this digital signature is the equivalent of your handwritten signature. Also, you, agree that you have read and understand all of the Membership Terms & Conditions, Terms of Use, our Privacy Policy and our Information Statement About Your Membership, and you agree to and do sign each section of this Membership Terms contract with your digital signature.

Authorization for Credit Repair Action

  1. 1.  I, Client, hereafter known as “client” hereby authorize, Credit Solutions,4444 Corona Drive Suite 127, Corpus Christi, Texas 78411, to make, receive, sign, endorse, execute, acknowledge, deliver, and possess such applications, correspondence, contracts, or agreements, as necessary to improve my credit. Such instruments in writing of whatever and nature shall only be effective for any or all of the three credit reporting agencies which are TransUnion, Experian, Equifax, and any other reporting agencies or creditor’s listed, as may be necessary or proper in the exercise of the rights and powers herein granted.
  1. This authorization may be revoked by the undersigned at any time by giving written notice to the party authorized herein. Any activity made prior to revocation in reliance upon this authorization shall not constitute a breach of rights of the client. If not earlier revoked, this authorization will automatically expire twelve months from the date of signature.
  1. The party named above to receive the information is not authorized to make any further release or disclosure of the information received. This authorization does not authorize the release or disclosure of any information except as provided herein.
  1. I grant to Credit Solutions,4444 Corona Drive Suite 127, Corpus Christi, Texas 78411, authority to do, take, and perform, all acts and things whatsoever requisite, proper, or necessary to be done, in the exercise of repairing my credit with the three credit reporting agencies, which are TransUnion, Experian, Equifax and any other reporting agencies or creditor’s listed, as fully for all intents and purposes as I might or could do if personally present.
  1. I hereby release Credit Solutions,4444 Corona Drive Suite 127, Corpus Christi, Texas 78411, from all and all matters of actions, causes of action, suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity, for or by reason of any matter, cause, or thing whatsoever as based on the circumstances of this contract.

Consumer Credit File Rights Under State and Federal Law

 

You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor a credit repair company or credit repair organization has the right to have accurate, current and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported up to 10 years.

You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.

You have a right to sue a credit repair organization that violated the Credit Repair Organization Act. This law prohibits deceptive practices by credit repair organizations.

You have the right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it.

Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur.

You may, on your own, notify a credit bureau in writing that you dispute that accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau.

If the credit bureau’s reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you.

Authorized User Agreement

This agreement is between me (each person who applies for the program or who signs this agreement) and CC Credit Solutions LLC.. and its affiliates, hereby referred to as Credit Solutions. I understand and agree that, although Credit Solutions may have offices in other territories, this authorized user agreement is offered only through the assigned affiliate for each contract under the laws of the assigned lender’s state that is the office I have solicited.

I hereby solicit Credit Solutions and apply to become an AUTHORIZED USER from COMPANY as is described herein below.

I hereby instruct Credit Solutions to add my name and social security as an AUTHORIZED USER to established, revolving credit card accounts determined by Credit Solutions. I understand that becoming an authorized user, the account(s) for which I have been authorized will issue a card(s) in my name, and that the card will be held by Credit Solutions. Charges are made to my card(s) and paid on time or in full monthly before the due date to ensure a consistent payment history. I understand that while the aged credit accounts I am purchasing have been proven to raise credit scores, I also understand my credit scores can go up, down, or remain the same! Credit Solutions has no control over the credit reporting process whatsoever, nor can they control the impact that any addition of a seasoned trade line(s) can have.

This Agreement describes the terms and conditions under which my aged credit accounts are issued. I certify that I am at least 18 years of age, and the information I provide to Credit Solutions in order to enroll in this program is true and accurate. I understand that my use of the account constitutes my acceptance of this account in accordance with the terms and conditions of this agreement.

I understand that the authorized user cards issued in my name will not be distributed to me and that they are retained by the company for reporting purposes. I also understand that Credit Solutions administrates all fees and I will be liable for the total amount of these fees as stated in this agreement.

CREDIT BUREAU REPORTING:  I understand that the trade lines assigned to my credit file are issued by institutions  that  are subscribers of the major credit  bureaus. My application information  will be submitted to the selected banks, and the next credit reporting period for those banks, the accounts selected by Credit Solutions will appear on my credit report dating back to the date the account was established. I also understand that the specific age and size of the trade line is subject to change at any time without notice, and is based on availability. I understand that while most trade lines are reported in 30-60 days, this process may take up to 120 calendar days for all trade lines to appear on my credit report(s). I also understand that even though the selected financial institutions reserve the right NOT to report to the credit bureaus at any time, Credit Solutions guarantees that all of my purchased trade lines will report to at least 2 out of 3 credit bureaus.

I further ratify the fact that my seasoned trade lines can take up to 120 calendar days to show up on my credit reports after my information is submitted. Credit Solutions cannot control the amount of time it takes each bureau to post credit information reported by any subscriber, nor predict the maximum impact of our service for each clients’ circumstances. Age of credit history, age of applicant, age of recent bankruptcies, etc., further compound this issue. I also understand that repeated credit attempts by me will result in negative impact on my reports by adding to my inquiries being reported in the two years allowed the bureaus to report, and said actions can negate the impact of this program.

Notice of Right to Cancel

  

”You may cancel this contract, without any penalty or obligation, at any time before midnight of the 3rd day which begins after the date the contract is signed by you.

”To cancel this contract, mail or deliver a signed, dated copy of this cancellation notice, or any other written notice to Credit Solutions, 4444 Corona Drive Suite 127, Corpus Christi, Texas 78411, before midnight on the 3rd day which begins after the date you have signed this contract stating ”I hereby cancel this transaction, (date) (purchaser’s signature).’’

I, Client,  hereby acknowledge with my digital signature, receipt of the Notice of Right to Cancel. I confirm the fact that I agree and understand what I am signing, and acknowledge that I have received a copy of my Consumer Credit File Rights.

By providing the information requested during our enrollment process, you will be given full access to the site for any paid membership. You must read the Important Consumer Notices and agree to the Membership Service Agreement which are shown below. You will also be accepting our Privacy Policy and Terms of Use where you are giving your permission to match you with offers, products and Apps that may be suited for you. Your Membership includes the following products:
Smart Credit Report®

This is a revolutionary new type of Credit Report and is not to be confused with a traditional credit report. What makes it so different is the way information is shown to you and how you can interact with your creditors by using action buttons. It also has a zoom feature to see more credit details and even your daily transactions that ultimately compromise of the information reported by a credit reporting agency.

Scores and ScoreTracker

Each of your Scores has a number ranging from bad to excellent along with a letter grade and how you compare to others. You also get a detailed overview of your Scores. All Scores are estimates and are for educational purposes only. They cannot be used to determine final credit.

Credit Score:

This is your credit score and its number range is 300-bad to 850-excellent. This score is a general representation of your credit risk lenders use to grant credit.

Auto Score:

This represents your possible risk to lenders if you purchase or lease a vehicle.

Insurance Score:

This represents your possible risk to an insurance company if they are underwriting your insurance.

Hiring Risk Index:

Many employers are allowed to view your credit report (not your credit score), when determining hiring or promotion. This Hiring Risk Index can help you better understand how employers may interrupt your credit report.

ScoreBuilder®

ScoreBuilder® is a 120 day program to better understand what is helping or hurting your credit score and view possible actions you can take on your own.

ScoreMaster® is also a great educational tool to better understand how your credit score works.

ScoreMaster® is a simulator showing possible outcome(s) of your credit score based upon certain actions you may optionally take that affects the statement balance reported by your creditor or bank. Alerts

This monitors information that is posted to a credit reporting agency (specifically TransUnion) or financial accounts once you add them to Money Manager. Some monitoring Alerts you may get are more important and urgent than others. For these important Alerts we recommend you activate Alerts on your phone. This will put an action button in your Alert to help you remove identity theft right from your phone without the need to log in to your account.

In addition, you will get various Alerts keeping you informed of the latest concerning your Money, Credit and Identity. The Alerts are simple and well organized for you. They include Alerts about your Membership, credit monitoring, identity theft alerts, creditor responses to your Actions and when payments are due on your Money Manager linked accounts.

Make sure you allow our Alerts to get to your email in-box by instructing your email that our Alerts are NOT spam.

$1MM Identity Fraud Insurance (if applicable)

Your $1mm Identity Fraud Insurance (“Fraud Insurance”) is underwritten and administered by Voyager Indemnity Company, an Assurant Specialty Property Company (“Assurant”) under a master group policy issued to ConsumerDirect, Inc®. for the benefit of it and its partners members.

BASED ON YOUR MEMBERSHIP, FRAUD INSURANCE MAY NOT BE AUTOMATICALLY ACTIVATED WHEN YOU ENROLL AS A MEMBER. YOU MUST ACTIVATE YOUR FRAUD INSURANCE.

The complete policy is available in the Fraud Insurance section of your membership. Please note that New York and Texas may have certain restrictions or prohibitions.

Assurant administers all claims and ConsumerDirect, Inc®. shall have NO responsibility with respect to ANY Fraud Insurance benefit.

PrivacyMaster® (if applicable)

We scan and monitor for websites & data brokers who might be selling or misusing your personal information and alert you when discovered.

You can then instruct them to Opt-Out of their sharing or selling your personal information. Or you can instruct them to completely Remove your personal information providing you do not have an open account with them.

We will monitor their compliance with your Opt-Out or Remove instructions.

You will get periodic alerts with updates and results. Your results may take from 1 to 45 days depending upon the responsiveness of the website or data broker’s compliance with your instructions. Results are not guaranteed and may vary.

Money Manager

Link your online bank accounts, credit cards, loans, utilities and investment accounts to Money Manager. This lets you see individual transactions, monthly statements and get payment due notices updated every day.

The details of these linked accounts are shown in Money Manager located on your Member home page and also attached to your creditor data on the Smart Credit Report®. If you view a creditor in your Smart Credit Report®, the transactions will appear as well.

Having all your money, credit and identity in one place is very simple and convenient, especially when you use an action button to ask your credit something.

Action Buttons*

Use the action buttons, located throughout the site, to communicate directly with your creditors for any questions, problems or requests you may have. It is very fast, you don’t need account numbers, or have to worry about business hours. Best of all, you don’t have to talk to anyone. Just push the button.

When a creditor replies to your Action request they may reply through our system which will then generate an Alert to you. Or, the creditor may reply directly to your home address. A creditor’s reply may vary depending on the general responsiveness of the creditor and your Action request. Please allow reasonable time for your creditor(s) to respond to your Action(s).

A creditor may reply with acceptance, denial, counter-offer or request for more information. In some cases, a creditor may not respond at all. In other cases, multiple Actions may be required to get the result you desire. Results or replies to your Action(s) are not guaranteed. Delivery of your Action(s) to a creditor is not guaranteed. We do reserve the right to reject any of your Actions for unnecessary repetition, frivolous requests or foul language.

You have until midnight, Pacific Time, to cancel your Action. After which our system will automatically fulfill your Action request.

Unlimited Scores is defined as 3 full Smart Credit Report® and Score updates per billing period. For the integrity of our product and for your protection, any request to exceed this will have to be determined as non-frivolous. ** Unlimited Actions are defined as 10 Actions per billing period. For the integrity of our product and for your protection, any Actions exceeding this will have to be determined as non-frivolous. ***Additional 3-Bureau Credit Report & Scores may be ordered with all active for a one-time fee if applicable. You may order up to one 3-Bureau Credit Report & Scores per day. The 3-Bureau Credit Report & Scores is available for 12 months or until a new 3-Bureau Credit Report & Scores has been ordered, at which point, the new report and scores will replace any existing 3-Bureau Credit Report & Scores.

We reserve the right to offer you different Membership plans at any time where the monthly charge, Actions per billing period and updates to your Credit Scores per billing period maybe different than listed above.

Our prices are subject to change at any time. Prior to any price increase, we will give you notice, and you may cancel your Membership if you do not agree to the increase.

When you enroll in Membership our system may validate your method of payment to verify your identity and check for fraud. If you have not cancelled your Membership, we reserve the right to use an industry standard credit/debit card updater to update your method of payment should your current method of payment be lost, stolen or expired.

You will be billed once per month on the anniversary of your bill date and your services will be renewed each month unless you cancel your membership. If your bill day is not available on a particular month, then you will be billed on the last day of that month.

You may cancel your Membership at any time by (1) using our Notice of Cancellation form below, or (2) log in to your account, or (3) call our customer service at (866) 991-1113.

If your method of payment for any charges described herein fails, you may lose access to your Membership.

We reserve the right to cancel your Membership without notice, if in our sole and exclusive determination, we find abuse of our system, including, but not limited to: improper enrollment information, false or failed credit cards and frivolous use of our action buttons or our Smart Credit Report®.

How does the Cancellation Policy work?

Canceling your Membership Account will immediately cease any additional charges. You agree to pay any accumulated, unbilled charges through the date of your cancellation, at the time of your cancellation. You may reactivate your account at any time.

Upon cancellation, you will lose access to the areas of the service designated for Members only and lose access to your data and other benefits. This could include any credit data and analysis that may have been displayed during your Membership.

You may cancel your Membership at any time by (1) using our Notice of Cancellation form below, or (2) log in to your account, or (3) call our customer service at (866) 991-1113.

IMPORTANT CONSUMER NOTICES

Please read the following important consumer notices carefully.

The Federal Trade Commission and some States’ Attorneys General regulate creditors, credit bureaus and credit care organizations. As a safe harbor statement please know: “You have the right to sue a credit services organization if it misleads you.”

CONSUMER CREDIT FILE RIGHTS UNDER STATE AND FEDERAL LAW

You have a right to obtain a copy of your credit file from a consumer credit reporting agency. They may charge a reasonable fee not to exceed eleven dollars ($11). There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information on your credit report within the preceding 60 days. There is also no fee if you certify that you are unemployed and intend to apply for employment during the next sixty (60) days, that you are a recipient of public welfare assistance, or that you have reason to believe that your file at such credit reporting agency contains inaccurate information due to fraud. You also have the right to receive one free copy of your credit report from each consumer credit reporting agency per year at the www.annualcreditreport.com web site.

The credit data provided or requested through our product is not intended to constitute the disclosure of information by a credit reporting agency as required by the Fair Credit Reporting Act or similar laws.

In addition, if you reside in the state of Colorado, Maine, Maryland, Massachusetts, New Jersey, or Vermont, you are entitled to receive a free copy of your credit report once a year and if you reside in the state of Georgia, you are entitled to receive a free copy of your credit report twice a year. Otherwise, a consumer reporting agency may impose a reasonable charge for providing you with a copy of your credit report.

You have a right to dispute inaccurate information by contacting the consumer credit reporting agency directly. However, neither you nor any company or credit services organization has the right to have accurate, current, and verifiable information removed from your credit report. Under the Federal Fair Credit Reporting Act, the consumer credit reporting agency and/or the reporting creditor must remove accurate negative information from your report only if it is over seven years old. Bankruptcy information can be reported for 10 years.

YOU UNDERSTAND ANY ACTIONS YOU MAY TAKE DO NOT GO TO ANY CREDIT REPORTING AGENCY/CREDIT BUREAU, BUT ONLY TO YOUR CREDITOR AS YOU SELECT AND INSTRUCT. IT IS YOUR CREDITOR’S SOLE AND ABSOLUTE DISCRETION TO RESPOND TO YOUR ACTION AS THEY DEEM NECESSARY. YOU ARE NOT REQUIRED TO PURCHASE YOUR CREDIT REPORT FROM US TO COMMUNICATE WITH YOUR CREDITORS. YOU MAY COMMUNICATE DIRECTLY WITH YOUR CREDITORS FOR ANYTHING YOU WISH AT ANY TIME.

If, separately from using our product, you have notified a credit reporting agency in writing that you dispute the accuracy of information in your credit file, the consumer reporting agency must then reinvestigate and modify or remove inaccurate information. The consumer credit reporting agency may not charge a fee for this product. Any pertinent information and copies of all documents you have concerning an error should be given to the consumer credit reporting agency. If reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the consumer credit reporting agency, to keep in your file, explaining why you think the record is inaccurate. The consumer credit reporting agency must include your statement about disputed information in any report it issues about you.

Nonprofit credit counseling services are available, usually without fees, to counsel you as to credit management and/or consolidation. Additionally, many of our product features you may perform on your own, such as our Actions. We are simply a neutral technology allowing consumers to communicate with their Creditors for whatever they need.

The E-Sign Act grants that electronic signatures on documents hold equivalent legal status as traditional handwritten signatures. Financial Information – such as information on your creditors and accounts and the specific actions you take with regard to those accounts, as well as your credit card information (used to pay for our services); In the course of providing services to you, we may also receive information about you from your creditors or the credit reporting agencies about your accounts. This information is classified as Financial Information.

Profile/Membership Information – such as demographic information, credit, identity and other personal profile data that you provide about yourself when you visit our website, register, or use our service, as well as, your Membership preferences.

From time to time, we may also collect or ask for additional Personal Information, which will also be expressly included herein as Personal Information. Any Personal Information you provide to us is voluntary and you can opt out of providing certain Personal Information requested by us. However, your refusal to provide certain Personal Information requested as part of our service may hinder or otherwise restrict your ability to use the website and services offered thereof.

Some of our services involve us acting as your authorized agent to make requests on your behalf. Before we act as your agent, you are required to provide information to us so that we may identify you. For example, our PrivacyMaster® services require you provide your name, mailing address, email, and a signature (electronic or written).

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use your credit card information to process payment for your Membership and other services that you purchase from us. We do not use your Financial Information for any other purposes.

We use your Personal Information to verify your identity, provide you with necessary Membership services, such as our Smart Credit Report®, PrivacyMaster®, determine what other products and services might be of interest to you, and for our internal administrative purposes.

We use the information that we collect to provide and maintain the website as we deem appropriate in our sole discretion and to provide the service through the website, and to provide any other services that you and CC Credit Solutions agree to. CC Credit Solutions may aggregate data that it obtains form users to analyze trends, to gather data to benchmark best practices, and to monitor, improve and refine the functionality of the website and services offered therefrom.

We may contact you by mail, telephone and/or email to better assist you with completing your enrollment or for other marketing purposes.

WHEN DO WE SHARE YOUR PERSONAL INFORMATION WITH OTHERS?

We may provide your personal information to third parties under the following circumstances:

We may disclose any personal information (including your Contact Information, Financial Information and Personal Information) with any third parties as needed to process your actions and provide the services that you request. For example, to complete an Action, we will disclose your contact information, account information, along with your Action request and Membership information to the creditor on your behalf. If you direct us to disclose your personal information to third-parties, we will do so in accordance with your instructions and the terms applicable to the particular service.

We may disclose any personal information with third parties that are performing services on our behalf. These third parties are required to protect your personal information and are not permitted to use it for any other purpose.

Unless you opt out (as described below), we may share your Contact Information and Personal Information with third parties so they may send you information about their products and services via electronic and conventional postal mail. We may also share your Contact Information and Personal Information with other financial institutions, in order to jointly market financial products and services to you.

We may disclose any personal information as required or as permitted by law. For example, we may disclose your information to prevent fraud or in response to a subpoena. We may also disclose your information as needed to protect our legal rights and enforce our terms.

In the event that CC Credit Solutions is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, CC Credit Solutions reserves the right to sell or transfer user information (including Personal Information) as part of any such transactions. To the maximum extent allowable by law, the Privacy Policy will apply to the user information as transferred to the successor entity. However, user information submitted after a transfer to a successor entity may be subject to a new privacy policy adopted by the successor entity.

If you are a Member, please login to your members.creditsolutions.com account. If you are not a Member, please contact Customer Service here. Please note, we are not able to update, modify, or correct personal information about you that we do not control.

HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

We have developed a formal information security program to safeguard the personal information that you entrust to us. Our security program includes reasonable technical, physical and administrative safeguards. For example, we restrict access to your information only to those employees who need to know that information to provide products or services to you.

We also take special steps to protect your information via transmission over the Internet by using a secure web server, which allows web browser programs (Mozilla/Firefox, Netscape, or Microsoft Internet Explorer) to interact with the web server via an encrypted session.
